Agreement

1. A minimum $500,000 general liability and $300,000 auto insurance is required.
a. The "Certificate Holder", Leann Shelly, The Barnacle Historic State Park. 3485 Main Highway, Miami, FL 33133.
b. Additional Insured are The Florida Department of Environmental Protection, the Trustees of the Internal Improvement Trust Fund, and Equipaws Pet Services, LLC.
2. The Permittee's location within the park will be determined by the Park Service Specialist and Equipaws Pet Services.
3. The Permittee shall hold harmless and indemnify the Barnacle Society, Inc., the State of Florida, the Department of Environmental Protection and the Board of Trustees of the Internal Improvement Fund and Equipaws Pet Services, LLC, against any and all liability, claims, judgements, or costs of whatsoever kind and nature of injury to, or death of, any person or persons, for loss or damages to any property resulting from the use, service, operation, or performance of work under the terms of this permit, resulting from any act or failure to act of the Permittee, or of any of the Permittee's employees, agents, or representatives to the extent allowed by law.
4. Permittee shall comply with all rules and laws governing the operation of the Park, including not altering or damaging the Park's natural or cultural resources in any way, and to be responsible for and fully repair all damage to Park facilities and resources which may result from any operations under this permit.
5. This permit may be terminated by either party at any time for failure to perform in accordance with the terms and conditions contained herein.
6. The Permittee shall obtain all permits and licenses necessary for the conduct of business and agrees to comply with all laws governing the responsibility of an employer with respect to persons it employs. The Permittee shall comply with all applicable federal, state, and local laws, rules, and regulations, including health and safety laws, rules, and regulations.
7. This Agreement has been delivered in the State of Florida and shall be construed in accordance wit the laws of Florida. Wherever possible, each provision of this Agreement shall be interpreted in such a manner as to be effective and valid under applicable law, but if any provision of this Agreement shall be prohibited or invalid under applicable law, such provision shall be ineffective to the extent of such prohibition or invalidity, without invalidating the remainder of such provision or the remaining provision of the Agreement.
8. This agreement represents the entire agreement of the parties and supersedes all previous agreements. Any alterations, variations, changes, modifications, or waivers of provisions of this Agreement shall be valid only when they have been reduced to writing, duly signed by all parties, and attached to the original Agreement.
